These Terms & Conditions govern the use of the Nucleèa Atelier website, user accounts, orders, products and services offered through the website.

By accessing the website, creating an account, placing an order or using any services provided by Nucleèa Atelier, the user agrees to these Terms & Conditions.

Nucleèa Atelier operates as an artistic handmade brand focused on collectible decorative objects, resin artworks, lamps, jewellery and custom artistic creations.

At the current stage of activity, Nucleèa Atelier operates as a non-registered business activity in accordance with applicable Polish regulations.

‘Website’ refers to the Nucleèa Atelier online platform and all related services.

‘Customer’ refers to any individual or entity using the website or placing an order.

‘Products’ include handmade artistic objects, lamps, lamp shades, trays, clocks, jewellery, custom works and other items offered by Nucleèa Atelier.

‘Custom products’ refer to personalized, commissioned or made-to-order products created specifically for an individual customer.

Nucleèa Atelier products are handmade artistic objects created individually or in small batches.

Products are artistic and decorative in nature first, while functional characteristics may be secondary depending on the product type.

Due to the handmade process, products may contain natural variations including but not limited to pigment movement, texture variations, minor asymmetry, small air bubbles, subtle scratches, edge irregularities, colour shifts or surface differences.

Such characteristics are considered part of the artistic nature of the products and do not constitute defects where they do not materially affect intended use.

Colours and finishes may appear differently depending on lighting conditions, screen calibration and device settings.

Orders are placed through the website or by individual agreement where applicable.

Nucleèa Atelier reserves the right to refuse or cancel orders in cases involving pricing errors, technical issues, suspected fraud, abuse, security concerns, unavailable materials or circumstances beyond reasonable control.

Products may occasionally become unavailable despite being visible on the website.

Custom and made-to-order projects may require individual communication and approval before production begins.

All prices are presented in the currency displayed on the website unless stated otherwise.

Prices may change without prior notice.

Payments may be processed through external payment providers including Stripe.

Nucleèa Atelier does not store full payment card details.

The customer is responsible for any customs duties, import taxes, currency conversion fees or local charges applicable outside the European Union.

Users may create accounts using authentication systems provided through the website.

The user is responsible for maintaining account security and confidentiality of login credentials.

Nucleèa Atelier reserves the right to suspend, restrict or remove accounts in cases involving abuse, fraud attempts, chargeback abuse, scraping, security violations, intellectual property infringement, platform attacks, unauthorized commercial use or violations of these Terms.

Resin is a material with naturally evolving visual and physical properties.

Minor visual changes may occur over time due to exposure to light, UV radiation, temperature, humidity or natural material aging.

Products may contain subtle air bubbles, texture variations, pigment movement, micro irregularities or other characteristics resulting from the handmade artistic process.

Such characteristics are considered natural features of the material and do not constitute product defects.

Certain products sold by Nucleèa Atelier include complete lamps, electrical components or standalone lamp shades.

Complete lamps are assembled using certified electrical components intended to comply with applicable European Union requirements.

Where applicable, complete lamps may carry CE marking and supporting technical documentation prepared by Nucleèa Atelier as manufacturer.

Thermal and usage tests may be performed to verify safe operation under intended conditions.

Standalone lamp shades sold separately are artistic decorative components and compatibility with third-party bases, fittings or electrical systems is the sole responsibility of the customer.

All lamps must be used strictly in accordance with the included safety instructions, warning labels, assembly instructions and QR-linked documentation provided with the product.

Unless otherwise stated in the product documentation, only LED bulbs with a maximum power of 6W may be used.

Use of incandescent bulbs, halogen bulbs, heat-generating bulbs or higher wattage bulbs may create unsafe conditions and void complaint claims relating to resulting damage where legally permitted.

Electrical components must not be modified, repaired, disassembled or replaced by unauthorized persons.

Pendant lamps, ceiling lamps and products requiring fixed electrical installation must be installed by a qualified professional with appropriate electrical qualifications.

Nucleèa Atelier may request documentation confirming compliant installation and compliant bulb usage during complaint or warranty assessment.

The customer is responsible for ensuring that the mounting surface, wall, ceiling or structure is suitable and capable of safely supporting the product.

Nucleèa Atelier is not responsible for failures of customer electrical systems, structural mounting failures, incorrect installation, misuse, incompatible systems or unsafe environmental conditions.

Products are intended for indoor decorative use unless explicitly stated otherwise.

Products must not be used in bathrooms, saunas, industrial environments, laboratories, outdoor environments, high-moisture areas or any environment unsuitable for decorative electrical products unless explicitly approved.

Products are not intended for uninterrupted industrial or commercial 24/7 operation unless explicitly stated.

Use with unsupported smart systems, dimmers, voltage converters or modified electrical systems is at the customer's own risk unless compatibility is explicitly confirmed.

Products must not be covered, enclosed without ventilation or exposed to excessive heat sources.

Nucleèa Atelier may offer custom jewellery or artistic products containing materials such as fur, feathers, teeth, hair or other customer-provided materials.

The customer confirms that they have the legal right to provide such materials.

Due to the handmade artistic process and unique nature of biological materials, exact visual outcomes cannot be guaranteed.

Custom and memorial products are highly personalized and may not be eligible for cancellation or return except where required by law.

All content associated with Nucleèa Atelier, including but not limited to photographs, designs, product concepts, collections, names, branding, logo, texts, descriptions, graphics, layouts and visual identity are protected by intellectual property laws.

Unauthorized copying, imitation, reproduction, resale, scraping, AI dataset collection, machine learning training use, commercial reuse, derivative work creation or exploitation of any materials is prohibited without prior written consent.

Use of the Nucleèa Atelier name, branding, collection names or visual identity in a misleading or impersonating manner is prohibited.

Nucleèa Atelier reserves the right to pursue legal action in cases of infringement or unauthorized use.

Some lifestyle visuals, conceptual presentations or atmospheric renders may be partially AI-assisted or digitally enhanced.

Actual product photographs represent real physical products unless explicitly stated otherwise.

Consumers retain mandatory rights provided by applicable Polish and European Union consumer laws.

Complaints should include order details, clear description of the issue and photographic documentation where applicable.

Nucleèa Atelier is not responsible for damage resulting from misuse, improper installation, unauthorized modification, incompatible electrical systems, failure to follow instructions, use of incorrect bulbs, improper maintenance or environmental conditions inconsistent with intended use.

To the maximum extent permitted by law, liability for indirect damages, consequential damages, lost profits or third-party damages is excluded.

Shipping, returns, withdrawal rights and complaint procedures are governed additionally by the Shipping & Returns section available on the website.

Users may not use the website for unlawful purposes, automated scraping, attacks, unauthorized data extraction, spam, fraud or activities disrupting website functionality.

Reverse engineering, automated copying or attempts to bypass website security measures are prohibited.

Nucleèa Atelier does not guarantee uninterrupted availability of the website.

Temporary interruptions, maintenance, updates, hosting issues or third-party service failures may occur.

Nucleèa Atelier shall not be liable for delays or failures caused by events beyond reasonable control, including but not limited to natural disasters, material shortages, transport disruptions, customs delays, power outages, wars, pandemics, strikes or technical failures.

These Terms & Conditions are governed by the laws of Poland and applicable European Union regulations.

Nothing in these Terms limits mandatory consumer protection rights applicable under local law.
